The story continues, NYCHA to Evict Family Member Not on Leases. This installment follows a tenant in the Linden Houses’ battle to remain in his home. This was supposed to be a simple, “What would you do” installment. Instead, it has led to the creation of a series of articles detailing the city’s plan for NYCHA.
At the end of this article, I will give you a glimpse into what I have found.
Normally I would recap part 1 of this article but there is much to cover here. To read the first installment click here.
NYCHA To Evict Family Member Not On The Lease Pt 1.
Now on the status of the eviction fight.
The Story Continues
One way to fight an eviction
As of this writing, Mac is still in his apartment in Linden Houses. He goes to his hearings and pays the rent on time. There had been threats to remove him from the apartment. But as long as he pays his rent he cannot be removed for non-payment of rent.
Note: As a former real estate broker the number one reason I heard for tenant eviction was non-payment of rent. So unless you have a bulletproof reason for not paying the rent, pay it.
5 Heart Attacks, 2 Strokes
Mac has had 5 heart attacks and 2 strokes. He has been in hospital after falling in his apartment. The episodes of falling becoming more frequent. Despite this, his desire to stay in the place he has called home keeps him moving. With the help of his home health attendant and his son, he has placed rental applications at various locations. And yes, he continues to pay his rent on time every time.
Next Court Date
You might think that NYCHA would back off knowing their actions are affecting a tenant’s health. And you would be dead wrong. Mac had another court date on February 2, 2020. The court is giving him until March of this year to locate an apartment. Bad health or not. But all is not lost. The story continues with a few twists.
Voucher
Mac has received a voucher for one thousand dollars ($1,000.00) from HRA. He can use this towards his rent in any location. So, if he moves the voucher goes with him. Why he was given this voucher is unknown. He never requested one.
Other Help
If you recall, the legal aid lawyer assigned to Mac’s case left the case just before a court date. Since then he has obtained a new lawyer.
HRA is helping him too. We’ll see how this works out.
An Uncertain Future
As I said this was supposed to be a short two-episode story. But that is not the case. There is no doubt that in March Mac will be back in court, once again fighting to stay in his home. And I will be looking for answers as to why this is happening.
The Search For Answers
The search for the reason NYCHA evicts family members, not on leases, may be coming to an end. During the course of writing these articles, I could not figure out why NYCHA was giving Mac such a hard time. That is until I heard that developers are taking over NYCHA complexes.
A Possible Reason Revealed
I contacted people I knew in Linden Houses trying to verify this. No one could help. Next, I spoke to my brother, a person in the know on housing matters. He told me that this has been going on for some time. My brother stated that Linden Houses and Boulevard Houses are test cases. He could not tell me who the developer or developers are. Finally, thanks to a Facebook group my finacæ belongs to I have a possible answer.

What do Mayor De Blasio, NYCHA, Ben Carson, and Mr. Trump Have In Common?
That answer is a deal that Mayor De Blasio and NYCHA have made with five developers. It began with a test run of three years. A federal program called RAD is the main component. Add to that something called Section 18 and the question arises, is affordable housing on its way out?
As I looked deeper into RAD I found that items that were happening to Mac made sense. In the next installment, we learn about RAD and Section 18. And you will begin to see why is looking not only to evict family members but most if not all public housing tenants.
Call to Action
If you live in the projects, know someone who lives in the projects, or has been evicted in the last 3 years you need to share these articles with them.
